OBL’s Customs Clearance (Claims) and Regulatory Compliance:

OBL may perform any of the following activities on Shipper's or Consignee’s behalf in order to provide services:

(1) complete any documents, amend product or service codes and advance any duties, taxes or other regulatory charges required under applicable laws and regulations ("Customs Duties").

In the event of claim OBL will intimate to EFU and EFU will process the claim as per policy. EFU will advise the amount payable. OBL will not first pay that amount to their customer(s), and then claim from EFU by providing the evidence of payment.

A: No claim for loss or damage will be entertained until all transportation charges have been paid.

B: ONESTBIRD Logistics does not maintain records relevant to a shipment of more than 45 days,

OBL Right of inspection of Shipment:

OBL has the right to open and inspect a Shipment without notice for safety, security, customs or other regulatory reasons.

In that event OBL will exercise all the reasonable care, but it shall not be liable for any damage to the shipment or any delay of the shipment or post arising as a result of any such examination.

OBL Limitation of Liability:

OnestBird Logistics shipping charges are mentioned on our website portal. All shipments with origin and destination with in Pakistan are Charged as per KG for Parcels either by Road, Rail or Air).

OBL will make every reasonable effort to deliver the Shipment according to OBL regular delivery schedules, but these schedules are not binding and do not form part of the contract. The Shipper/Sender/Client undertakes that no claim shall be made against any Director, Servant, Employee, Agent, Franchisee, or Sub-Contractors of OBL.



Liabilities Not Assumed by OBL:

The Shipper/Sender/Client acknowledges that the consignment/shipment shall be transported by road and /or air and shall therefore be exposed to all risks usually to be associated with such mode of transportation. However, OBL will not, under any circumstances be liable for delay in pick up, transport or delivery of any shipment regardless of the cause of such delay.

• “Act of God” for example including earthquake, cyclone, storm, flood or “force majeure”. For the purposes of these terms and conditions, “Force Majeure” means an event which is beyond the reasonable control of OBL and making it impossible for the purpose of performing its obligations/duties. OBL shall neither be held liable for any delay in or failure to perform or observe its obligations under this terms and conditions.

OBL Insurance:

It is mandatory upon shipper to arrange for insurance of all shipment through OnestBird Logistics COD or any insurance company.

OBL in writing, including by completing the insurance section of the waybill or using OBL automated systems and pays the applicable premium. Shipment insurance does not cover indirect loss or damage, or loss or damage caused by delays.

OBL Lawfulness of Shipment/Goods:

• It is declared that OBL being only responsible for warehousing/transportation of shipments/goods of Shipper/Client/Sender, any liability, loss, claim, demand, action, proceeding.

• All shipment/items are legal commodity and is allowed by Pakistan. OBL doesn’t contain any banned / prohibited or item falling under DGR category.

Shipper/Client/Sender Has Asked OBL To Bill Receiver/Third Party:

The Shipper/Client/Sender agrees to pay all shipment charges and destination duties, levies and taxes, for the shipment. If the receiver or third party does not pay with OBL retaining the right to hold onto such shipment/goods/cargo until such payment is made.

OBL Shipment Charges, Duties and Fees:

OBL Shipment charges are calculated according to the higher of actual or volumetric weight per piece and any piece may be re-weight and re-measured by OBL to confirm this calculation which should be pay by costumer.

Variable Fuel Adjustment Would be Applicable As Per Practice/Arrangements:

All the rates/charges pertaining to the shipments shall be subjected to fluctuation of prices in the fuel and OBL`s decision regarding the same shall be final and binding as per the business arrangement.

Oversized/Odd Sized OBL Shipment Rules:

Additional charges for lifter/cranes, special handling would also apply along with agreed rates and the shipment weight would be charged gross or volumetric whichever will be higher at the time of its final weighing by OBL.
